1. Welcome to SongSpan

These Terms of Service ("Terms") govern your access to and use of SongSpan ("we," "our," or "the Service"), a music journaling application. By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

2. Account Registration and Eligibility

2.1 Age Requirement: You must be at least 13 years old. Users under 18 require parental or guardian consent.
2.2 Account Security: You are responsible for maintaining your login credentials and for all activity under your account.
2.3 Accuracy: You agree to provide accurate information and keep it updated.
2.4 Single Account Use: You may not create multiple accounts or share accounts.

3. User Content

3.1 Ownership: You retain ownership of all content you create in SongSpan, including journal entries, tags, and mood logs ("User Content").
3.2 License to Operate Service: You grant SongSpan a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your User Content solely to operate and improve the Service.
3.3 Aggregated Data: We may use anonymized and aggregated data for analytics and service improvement. This data will not reasonably identify you.
3.4 Prohibited Content: You may not create or upload unlawful, infringing, abusive, or harmful content.

4. Acceptable Use

You agree not to use the Service for unlawful purposes; interfere with or disrupt the Service; attempt unauthorized access to systems or accounts; upload malware or malicious code; scrape or extract data using automated methods; reverse engineer or exploit the Service; or misrepresent your identity or affiliation.

5. Third-Party Services and Content

SongSpan may rely on third-party services for functionality, including music metadata, artwork, links, payment processing, analytics, and error monitoring. SongSpan uses Apple's iTunes Search API to retrieve music metadata and artwork. This does not connect SongSpan to your Apple Music account or provide access to your Apple Music library or listening history. Third-party content remains the property of its respective owners. We do not claim ownership of music, recordings, or associated intellectual property.

6. No Medical or Therapeutic Advice

SongSpan is not a medical, psychological, or therapeutic service. All features, insights, or suggestions are for informational purposes only and are not a substitute for professional advice, diagnosis, or treatment. 7. Subscriptions and Payments

7.1 Billing: Subscriptions are billed in advance and renew automatically unless canceled.
7.2 Cancellation: You may cancel anytime. Access continues until the end of the billing period.
7.3 No Refunds: Payments are non-refundable except where required by law.
7.4 Price Changes: We may change pricing with reasonable prior notice.

8. Privacy

Your use of SongSpan is governed by our Privacy Policy at https://songspan.app/privacy. We do not sell personal data. Journal data is treated as private. You may export or delete your data.

9. Intellectual Property and DMCA

We respect intellectual property rights and respond to valid DMCA takedown notices. Reports may be sent to contact@songspan.app. Repeat infringers may have accounts terminated.

10. Service Changes and Termination

We may modify or discontinue the Service at any time. You may delete your account at any time. We may suspend or terminate accounts for violations of these Terms or misuse of the Service. Upon termination, access to the Service ends immediately.

11. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, SongSpan is not liable for indirect, incidental, or consequential damages, including loss of data or profits. Our total liability will not exceed the amount you paid in the 12 months prior to the claim.

12. Dispute Resolution

Informal resolution is required before legal action; contact contact@songspan.app. Binding arbitration and a class action waiver apply where legally permitted. Governing law is determined by Company jurisdiction.

13. General

We may update these Terms at any time. Continued use constitutes acceptance. If any provision is unenforceable, the remainder remains valid. You may not assign these Terms without consent.
